U.S. Judge Paul S. Grewal has sanctioned against Samsung killing an important defense the company could have against Apple's accusations of design stealing because the court had ordered the South Korean company to release source code and other documents that could Apple's point that Samsung wilfully infringed patents registered by them.
The Court had ordered Samsung to release such papers on December 22, and the company hasn't released a single paper since it was ordered to. Apple filed a claim in March stating that Samsung refused to comply with a Court order stating that this would further prove the company's claim that Samsung is "hiding" something.
A response to Apple's filing came up on Court last week and came to public knowledge this Monday (May 7th). The Judge harshly forbid Samsung from defending itself on the cases related to the ’381, ’891, and ’163 patent and shall not argue over any decision the Court may take in these cases.
