Apple Fails to Put an Emergency Ban on All HTC Phones

The US International Trade Commission has denied Apple’s request to put an emergency ban on HTC phones for infringing on a patent. Apple accuses the Taiwan handset manufacturer for infringing on a patent despite an exclusion order issued on last December.

The ITC launched an investigation on Sunday and found that “Apple has not demonstrated the propriety of temporary emergency action here". "The commission will not direct Customs to detain all subject HTC products because the commission does not have the information necessary to determine whether the respondents are currently violating the commission's limited exclusion order," they added.

HTC’s latest device Evo 4G LTE and One X were help up in customs for about a month as the officials wanted to check if the devices are patent-infringing. But the devices finally made its way to the US market after a month. HTC infringed on Apple’s “data tapping” technology and received a deadline from the ITC to remove the feature from all their devices to avoid an import ban earlier. Now the company can continue to import HTC devices in the US until the ITC finds something more accurate.
