Judge Says Apple’s ‘Smoking Crack” after seeing rebuttal witness list

It was expected that the battle between Apple and Samsung in the courtroom would be epic but now it’s also getting entertaining. Judge Lucy Koh wondered if the Apple lawyers are smoking crack after Apple submitted a 75-page briefing that outlined that they are planning to call 22 additional witnesses in the four hours it had left.

Koh said after seeing the lengthy document, "when unless you're smoking crack you know these witnesses aren't going to be called!" Later, William Lee, Apple’s attorney said in his defense, "First, your honor, I'm not smoking crack. I can promise you that." He said the company’s legal team is ready to pare down the document and some of the witnesses mentioned in the document were Samsung’s witnesses, not Apple’s.

The judge grew more frustrated as the discussion continued and then said “I’m billing time because you all are being unreasonable.” Apple flared Koh’s temper earlier this week when they planned to bring in designer Susan Kare for testimony and failed to do so. This makes one thing clear, Judge Koh is trying to complete the trial on schedule and will not hold back.
